Chester Road Scheme CPO – A5117 Deeside Park Junction Improvements

If your property has been affected by the recent junction improvement and road widening works you may be eligible to claim under Part 1 of the Land Compensation Act (1973) otherwise referred to as a Part 1 Claim.

To be eligible to claim, the Claimant must have a qualifying interest which has been depreciated due to physical factors caused by the use of the altered highway.  Such physical factors may include noise, vibration, smell, fumes, smoke and artificial lighting. 

To be eligible, the Claimant must be able to produce evidence of his/her interest in the property and this must be freehold. 

Anyone having a qualified interest who considers they may have a claim can obtain further information and a Part 1 Claim Form from the Highways Agency, C25 Broadway, Broad Street, Birmingham, B50 1BL or alternatively can delegate the whole claim process through an agent.  Denton Clark has practical knowledge of dealing with the scheme from inception to completion and is currently retained by many clients affected including Part 1 claimants.  As with all CPO matters, agent’s fees should be fully covered by the Highways Agency, where legitimate.

No claim can be submitted until 12 months after the official opening date which will be March 2010.  It is, however, advisable for potential claimants to start the process by instructing an agent to consider the claim valuations at an early stage as any loss in value is based on values at the opening date of 3rd March 2009.
